    Who does it apply to?

    Temporary residence due to other circumstances shall be granted if circumstances which are the basis to apply for this permit justify the residence on the territory of the Republic of Poland for a longer period than 3 months, for example if the foreigner: intends as a family member to reside in Polish territory together with the migrant worker, holds a long-term resident’s EU residence permit granted by another Member State of the European Union, takes up or continues education or vocational training or is a clergyman.

    Additional documents

    You are obliged to submit :

    In case you apply for a temporary residence permit and you are going to live in Poland making a family with a migrant worker as defined in the article 19 part I and the article 19 part II of the European Social Charter done at Turin on October 18, 1961, or with a foreigner running his own business mentioned in the article 19 paragraph 10 part II of the European Social Charter done at Turin on October 18, 1961.:

    • documents confirming possessing a health insurance or coverage by the insurer of the cost of medical treatment in Poland (e.g. ZUS – Polish Social Insurance Institution - certificate, other insurance policy);
    • documents confirming possessing having a stable and regular source of income sufficient to cover the costs of living for yourself and your family members dependent on you (e.g. employment contract, income and salary statement);
    • documents, recognized by Polish law, confirming the degree of yours relationship (a marriage certificate, a birth certificate);
    • a residence card or Polish administrative decision conforming that the foreigner with whom you are making a family has right to stay legally in Poland (a copy to deliver and the original available for inspection);
    • documents confirming that you have got a permanent dwelling place (e.g. permanent residence certificate, residence lease agreement, residence lending contract, any other agreement giving you the rights to housing premises or someone else’s declaration to provide you a permanent dwelling place in Poland).

    If your stay in Poland is illegal but your departure would violate child’s rights embodied in the United Nations Convention on the Rights of the Child of 20 November 1989:

    • Documented evidence of child’s mental and physical state;
    • documents confirming the existence of relationship or kinship with a child under the age of 13 (e.g. birth certificate).

    If your stay in Poland is illegal but you are conducting family life within the meaning of the Convention for the Protection of Human Rights and Fundamental Freedoms signed in Rome on 4 November 1950.;

    • Documents confirming that you are making a family life within the meaning of the Convention for the Protection of Human Rights and Fundamental Freedoms signed in Rome on 4 November 1950 .

     

    In case you apply for a temporary residence permit and you are a victim (aggrieved party) in a lawsuit:

    • documents confirming possessing a health insurance or coverage by the insurer of the cost of medical or ambulatory treatment in Poland (e.g. ZUS – Polish Social Insurance Institution - certificate, other insurance policy);
    • documents confirming that you have got a permanent dwelling place (e.g. permanent residence certificate, residence lease agreement, residence lending contract, any other agreement giving you the rights to housing premises or someone else’s declaration to provide you a permanent dwelling place in Poland).
    • documents confirming that you can afford (meet) your living costs in Poland.
    • documents confirming that a civil proceedings on obtaining your unpaid remuneration are in progress.

    When applying for a temporary residence - in case you were granted a victim status in a penal procedure against a dishonest employer:

    • documents confirming that you were granted a victim status in a penal procedure against a dishonest employer according to art. 10 par. 1 of the Act of the 15th June 2012 on corollaries resulting from employing foreigners who have no legal residence in Poland (the title in Polish: „Ustawa z dnia 15 czerwca 2012 r. o skutkach powierzenia wykonywania pracy cudzoziemcom przebywającym wbrew przepisom na terytorium Rzeczypospolitej Polskiej”).

    In case you apply for the temporary residence permit and you are a clergyman, a member of a religious order or a person performing religious functions in a church or a religious association:

    • documents confirming you have got a health insurance to cover costs of hospital and ambulatory treatment on the territory of Poland (e.g. an applicable certificate from ZUS - Polish Social Insurance Institution, insurance policy etc.)
    • documents confirming that you have got a permanent dwelling place (e.g. permanent residence certificate, residence lease agreement, residence lending contract, any other agreement giving you the rights to housing premises or someone else’s declaration to provide you a permanent dwelling place in Poland).
    • any document confirming that your stay in Poland is related with the religious function or that you are preparing to perform such a function

    In case you apply for a temporary residence and you have graduated from Polish university (academy) and you are seeking a job in Poland:

    • documents confirming you have got a health insurance to cover costs of hospital and ambulatory treatment on the territory of Poland (e.g. an applicable certificate from ZUS - Polish Social Insurance Institution, insurance policy etc.)
    • documents confirming that you have got a source of stable and regular income sufficient to cover the costs of living for yourself and your family members dependent on you (e.g. employment contract, employment and salary certificate)
    • Documents confirming that you have got a permanent dwelling place (e.g. permanent residence certificate, residence lease agreement, residence lending contract, any other agreement giving you the rights to housing premises or someone else’s declaration to provide you a permanent dwelling place in Poland).
    • Polish university (academy) diploma

    In case you apply for temporary residence for the purpose of undertaking or continuing education:

    • certificate that you have enrolled or are continuing your studies/course
    • documents confirming that you have got sufficient financial resources to cover the tuition fees, living costs and your return to your motherland (e.g. a bank account balance)
    • Documents confirming possessing a health insurance or coverage by the insurer of the cost of medical or ambulatory treatment in Poland (e.g. ZUS – Polish Social Insurance Institution - certificate, other insurance policy);
    • Documents confirming that you have got a permanent dwelling place (e.g. permanent residence certificate, residence lease agreement, residence lending contract, any other agreement giving you the rights to housing premises or someone else’s declaration to provide you a permanent dwelling place in Poland).

    In case you apply for a temporary residence permit for the purpose of undertaking or continuing your professional training:

    • a certificate confirming that you start or continue your professional training, issued by the appropriate training institution
    • documents confirming possessing a health insurance or coverage by the insurer of the cost of medical or ambulatory treatment in Poland (e.g. ZUS – Polish Social Insurance Institution - certificate, other insurance policy);

    If you are a Turkish citizen eligible to work in Republic of Poland, as stated in Decision No 1/80 of the Association Council between the EEC and the Republic of Turkey of 19 September 1980 and  you apply for a temporary residence :

    • documented evidence of work performing on the Poland’s territory (e.g. work permits, employment contracts, employment certificates, job offer from Polish Employment Office or ZUS [Polish Social Insurance Institution] documents) – to determine your eligibility for work in Republic of Poland as stated in Decision No 1/80 of the Association between the EEC and the Republic of Turkey Council of 19 September 1980;
    • Document confirming running business activity- contract of employment or employer’s declaration of the intention to commission work to a foreigner.
    • certificate that you have enrolled or are continuing your studies/course
    • documents, recognized by Polish law, confirming the degree of yours relationship (a marriage certificate, a birth certificate) - for a family member of a foreigner holding a long-term resident’s EU residence.
    • A long-term resident’s EU residence permit granted by another Member State of the European Union and residence card.

    If you apply for a temporary residence, provided you hold a long-term EU resident permit issued by another EU Member State and:

    a) you intend to work or conduct a business in Poland in accordance with the Polish laws or
    b) you intend to start or continue studying or vocational training in Poland or
    c) you can prove that there are other circumstances justifying your residence in Poland or you are a member of the above-mentioned foreigners’ family with whom you have been living on the territory of another EU Member State and you accompany them or wish to join them:

    • documents confirming possessing a health insurance or coverage by the insurer of the cost of medical or ambulatory treatment in Poland (e.g. ZUS – Polish Social Insurance Institution - certificate, other insurance policy - for instance: ZUS RCA report signed by an authorised person);
    • documents confirming possessing having a stable and regular source of income sufficient to cover the costs of living for yourself and your family members dependent on you (e.g. employment contract, income and salary statement)
    • documents confirming that you have got a permanent dwelling place (e.g. permanent residence certificate, residence lease agreement, residence lending contract, any other agreement giving you the rights to housing premises or someone else’s declaration to provide you a permanent dwelling place in Poland).
    • any documents justifying your living in Poland:

    In case you apply for a temporary residence permit for a child born in Poland:

    • The child's birth certificate
    • document proving custody

    Applying for a temporary residence permit because of other reasons mentioned previously, which justify your stay in Poland:

    • documents which confirm that your stay in Poland for more than 3 months is legal (e.g. a marriage certificate, a birth certificate, a card of identification, residence permit of a member of a family).
    • documents confirming possessing a health insurance or coverage by the insurer of the cost of medical or ambulatory treatment in Poland (e.g. ZUS – Polish Social Insurance Institution - certificate, other insurance policy);
    • documents confirming possessing having a stable and regular source of income sufficient to cover the costs of living for yourself and your family members dependent on you (e.g. employment contract, income and salary statement).
