    Permanent residence permit is granted for a person who

    1) Is a child of a foreigner who has been granted a permanent residence permit or a long-term resident's EU residence permit remaining under his parental authority:

    - born after the parent was granted a permanent residence permit or a long-term resident's EU residence permit,

    - born during validity period of temporary residence permit granted to this foreigner,

    2) is a child of a Polish citizen remaining under his parental authority,

    3) is of Polish origin and intends to settle permanently in Poland,

    4) formally stays in the bonds of marriage with the Polish citizen, according to Polish law, for at least 3 years prior to the date on which he applied for a permanent residence permit and immediately before submitting the application he resided continuously in Poland for a period shorter than 2 years on the basis of a residence permit issued for a fixed period, granted in connection with staying in the bonds of marriage with a Polish citizen or because he obtained refugee status, subsidiary protection or a residence permit for humanitarian reasons;

    5) is a victim of human trafficking according to the meaning of art. 115 § 22 of the Penal Code,

    6) immediately before submitting the application he resided continuously in Poland for a period not shorter than 10 years on the basis of consent for tolerated stay or for 5 years because he obtained refugee status or subsidiary protection;

    7) has a Polish Card and intends to settle permanently in Poland.

    Documents

    If you apply for a permanent residence permit you should submit:

    • A photocopy of a valid travel document (original for inspection), in particularly justified cases, when a foreigner does not have a valid travel document and is not able to obtain, he/she may provide another document confirming his / her identity,
    • 2 (original + copy) temporary residence permit form, filled in according to the guidelines; if the child is under 13 only the original is needed,
    • 3 up-to-date colourful biometric photographs (i.e. taken within last 6 months); if the child is under 13 only 2 photographs are needed,
    • documents confirming the required, uninterrupted stay in Poland (e.g. decisions for temporary stay).

    Additionally you should submit:

    in the case of a minor who is a child of a foreigner holding a permanent residence permit or a long-term resident's EU residence permit and remaining under his parental authority:

    • photocopy of a residence card and a permanent residence decision permit or a long-term resident's EU resident permit;
    • birth certificate of a foreign child.

     

    In the case of a child of a Polish citizen remaining under his parental authority

    • photocopy of the ID card of the statutory representative;
    • birth certificate of a foreign child;
    • documents confirming the exercise of parental responsibility over the child.

     

    If you are a person of Polish descent and intend to settle permanently in Poland, to determine that you have Polish origins the provisions of art. 5 para. 1-3 of the Act of 9 November 2000 on Repatriation (Journal of Laws of 2004 No. 53, item 523, as amended) are applicable

    As proofs of Polish origin may be used documents issued by Polish state or church authorities, including the authorities of the former Soviet Socialist Union, regarding the applicant or his parents, grandparents or great-grandparents, in particular:

     

    • Polish identity documents,
    • civil status records or their copies or baptism certificates confirming your relationship with Polish nationality,
    • documents confirming the completion of military service in the Polish Army, containing an entry informing about Polish nationality,
    • documents confirming the fact of deportation or imprisonment, containing an entry informing about Polish nationality,
    • identity documents or other official documents containing any entry informing about Polish nationality,
    • documents on the rehabilitation of a deported person, containing an entry informing about Polish nationality,
    • documents confirming the persecution of a person due to her/his origin,
    • any documents confirming the relationship with Polish nationality, which may contribute to acknowledge that you have Polish origins,
    • documents confirming your intention to stay permanently in Poland.

     

    In the case of a marriage with a Polish citizen

    • a valid copy of the marriage certificate, issued not earlier than 3 months before submitting the application,
    • a photocopy of the spouse's identity card - (the original available for inspection),
    • In case of having common children - copies of birth certificates of children.

     

    If you are a victim of human trafficking

    • photocopy of temporary residence permit for victims of human trafficking,
    • certificate on cooperation with law enforcement agencies in criminal proceedings in the offense referred to in article 198a § 1 of the Criminal Code;
    • circumstances justifying the fear of returning to the country of origin, confirmed by the prosecutor conducting proceedings in the case of a crime referred to in article 198a § 1 of the Criminal Code,

    If you have been continuously in Poland immediately prior to submitting the application for a period at least 10 years on the basis of a tolerated stay permit granted on the basis of art. 351 item 1 or 3 of the Act on foreigners:

    • photocopy of the decision on granting permission for tolerated stay (the original available for inspection),

    In the case of granting Polish asylum on the territory of the Republic of Poland

    • photocopy of the decision on granting Polish asylum in Poland (the original available for inspection),

    If you have a valid Polish Card

    • photocopy of a valid Polish Card (original for inspection);
    • documents confirming your intention to remain permanently in Poland (e.g. registered residence confirmation, flat renting agreement, contract of employment, certificate that you study at a Polish university).

    Decision issuing authority

    The decision on granting a permanent residence permit is issued by the voivode competent for the place of residence of the foreigner. The application for permanent residence permit shall be made on the form.

  • IV

    Charges

    The stamp duty can be paid in cash at the cash desk at the Municipal Office in Katowice or cashlessly (bank transfer) to the mentioned below bank account of Municipal Office in Katowice:

     According to the Art. 6 par. 1 point 3 of the Act of November 16, 2006 on stamp duty, proof of payment for the permit should be attached to the application when submitting the application.

     A person applying for a permanent residence permit, possessing a valid Polish Card, is exempt from stamp duty.

    After submitting the application form, the foreigner will receive a letter with the date of his/her fingerprints and the list of other documents he/she needs to submit.
