1) Is a child of a foreigner who has been granted a permanent residence permit or a long-term resident's EU residence permit remaining under his parental authority:
- born after the parent was granted a permanent residence permit or a long-term resident's EU residence permit,
- born during validity period of temporary residence permit granted to this foreigner,
2) is a child of a Polish citizen remaining under his parental authority,
3) is of Polish origin and intends to settle permanently in Poland,
4) formally stays in the bonds of marriage with the Polish citizen, according to Polish law, for at least 3 years prior to the date on which he applied for a permanent residence permit and immediately before submitting the application he resided continuously in Poland for a period shorter than 2 years on the basis of a residence permit issued for a fixed period, granted in connection with staying in the bonds of marriage with a Polish citizen or because he obtained refugee status, subsidiary protection or a residence permit for humanitarian reasons;
5) is a victim of human trafficking according to the meaning of art. 115 § 22 of the Penal Code,
6) immediately before submitting the application he resided continuously in Poland for a period not shorter than 10 years on the basis of consent for tolerated stay or for 5 years because he obtained refugee status or subsidiary protection;
7) has a Polish Card and intends to settle permanently in Poland.

The decision on granting a permanent residence permit is issued by the voivode competent for the place of residence of the foreigner. The application for permanent residence permit shall be made on the form.

According to the Art. 6 par. 1 point 3 of the Act of November 16, 2006 on stamp duty, proof of payment for the permit should be attached to the application when submitting the application.
A person applying for a permanent residence permit, possessing a valid Polish Card, is exempt from stamp duty.
